– All domestic and foreign organizations and individuals have activities discharging waste into water sources and have a wastewater treatment system without a discharge report.

Agency to receive and manage records and report wastewater discharge into water sources
Depending on the scale and volume of wastewater discharged into the receiving source, the receiving agency includes:
– Department of Water Resources Management under the Ministry of Natural Resources and Environment. Responsible for receiving, appraising and managing documents and licenses under the licensing authority of the Ministry of Natural Resources and Environment.
– The Department of Natural Resources and Environment is responsible for receiving, appraising and managing documents and licenses under the licensing authority of the Provincial People’s Committee.
* Validity of a permit to discharge wastewater into water sources.
The discharge permit has a maximum term of 10 years, a minimum of 03 years and can be considered for renewal many times, each extension is a minimum of 02 years, a maximum of 05 years.
* Conditions for renewing discharge permits
– The license is still valid and the application for license renewal is submitted at least 90 days before the license expires.
– By the time of request for extension, the licensed organization or individual has fully completed the obligations related to the issued license according to the provisions of law and there is no dispute.
– At the time of requesting to extend the discharge permit of an organization or individual in accordance with the water resources planning and the capacity of the water source.
Order and procedures for registering a permit to discharge wastewater into water sources
– Organizations and individuals submit 02 sets of documents and pay the application appraisal fee to the application receiving agency.
– Within 10 working days from the date of receipt of the application, the receiving agency is responsible for reviewing and checking the application. In case the dossier is invalid, the dossier-receiving agency shall notify the organization or individual to supplement and complete the dossier according to regulations.
– Within 30 working days from the date of receipt of complete and valid documents, the receiving agency is responsible for appraising the project, reporting, and if necessary, inspecting the actual site and setting up a council. Evaluate projects and reports.
–Within 05 working days from the date of receiving the license from the competent authority, the agency receiving the application shall notify the organization or individual to receive the license.
* Procedure for renewing discharge permits
– Organizations and individuals submit 02 sets of documents and pay the application appraisal fee to the application receiving agency.
– Within 05 working days from the date of receiving the application, the receiving agency is responsible for reviewing and checking the application. In case the dossier is invalid, the dossier-receiving agency shall notify the organization or individual to complete the dossier according to regulations.
– Within 25 working days from the date of receipt of complete and valid documents, the receiving agency is responsible for evaluating the project and report, if necessary, physically inspecting the scene and setting up an appraisal council. define projects and reports.
– Within 5 working days from the date of receiving the license from the competent authority, the agency receiving the application shall notify the organization or individual receiving the license.
Registration documents for wastewater discharge permit
– Application for license, in case wastewater has not yet been discharged, report on the status of wastewater discharge along with operating procedures of the wastewater treatment system for cases in which wastewater is being discharged
– Analytical results of the quality of the receiving water source at the discharge location
– Waste discharge project with wastewater treatment system operating procedures for wastewater quality before and after treatment. For cases where wastewater is being discharged. The time of sampling for water quality analysis is no more than 03 months from the time of application submission
– Location map of wastewater discharge area.
– In case there is no wastewater discharge facility, the application for a license must be submitted during the investment preparation stage.
* Dossier to request extension of discharge permit includes
– Application for license renewal.
– Results of analysis of wastewater quality and quality of receiving water sources at the discharge location. The time of sampling for water quality analysis is no more than 03 months from the time of application submission.
– Report on the current status of wastewater discharge and the implementation of regulations in the license. In case of adjusting the scale, method, wastewater discharge regime, and operating procedures, there must be a wastewater discharge plan.
– Copy of the issued license.
